High Court Maintains Original Ruling for Home Intruder
A man who broke into the private residence of actress Nana has been sentenced to a heavy prison term once again in an appellate court trial.
On October 22, the Criminal Division 14-3 of the Seoul High Court, led by Senior Judges Jeong Gyeong-geun, Lee Hyeong-geun, and Lee Hyeon-woo, held an appellate sentencing hearing for an individual identified as A, who was indicted on charges of robbery causing injury.
During the proceedings, the appellate bench chose to dismiss the appeals filed by both the prosecution and the defendant, thereby upholding the original sentence handed down in the initial trial. Consequently, the court sentenced defendant A to 7 years in prison, matching the exact penal duration established by the court of first instance.
In rendering its decision, the judicial panel determined that the original trial court's verdict was entirely appropriate. The judges specifically took into consideration several critical factors, including the fact that the crime occurred during nighttime hours, the perpetrator illegally entered the residential space while carrying a dangerous weapon, and the individual inflicted physical injury upon the victim.
Details of the Incident and False Counter-Accusation
Defendant A was originally charged with breaking into Nana's private residence located in Guri, Gyeonggi Province, on November 15 of last year, where he attempted to demand money and valuable goods before failing in his effort. Reports confirm that during the break-in, the perpetrator physically threatened the artist's mother, which included choking her by the neck.
Following the initial confrontation, defendant A took the step of filing a legal complaint against Nana, accusing her of attempted murder and special bodily injury. He claimed that he sustained physical injuries himself while being subdued during the break-in attempt. However, law enforcement authorities ultimately closed that specific investigation after deciding not to forward the case to prosecutors.
In response to those claims, Nana pursued legal action of her own by filing a counter-complaint against defendant A on charges of false accusation. Prosecutors recently indicted defendant A on those additional charges, and he is currently awaiting court proceedings related to that pending trial.
